Sending a takedown notice

Your notice needs six things. This is what the law asks for, and a notice missing any of it may not be actionable:

Your physical or electronic signature.
Identification of the copyrighted work you say has been infringed.
Identification of the material you want removed, and enough detail for us to find it, which in practice means the full web address.
Your address, telephone number, and email address.
A statement that you believe in good faith that the use is not authorized by the copyright owner, its agent, or the law.
A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner.

What we do about it

We review promptly. Where a complaint is well founded we remove the material or disable access to it, and we tell the scholar whose site it appeared on what was removed and why, along with how to respond.

If your material was removed

If you believe we removed something by mistake, or that it was misidentified, you may send a counter notice to the same agent. It needs:

Your physical or electronic signature.
Identification of the material that was removed, and where it appeared before removal.
A statement, made under penalty of perjury, that you believe in good faith the material was removed as a result of mistake or misidentification.
Your name, address, and telephone number.
A statement that you consent to the jurisdiction of the federal court for the district where you live, or where we are located if you live outside the United States, and that you will accept service of process from the person who filed the notice.

Where the law allows it, we may restore the material after a waiting period unless the party who filed the original notice tells us they have gone to court.

Repeat complaints

A scholar whose material draws repeated, well founded complaints may have their site suspended. We would rather talk it through first, and in almost every case a correction settles the matter.

A word about false claims

Knowingly misrepresenting that material is infringing, or that it was removed by mistake, carries liability under the same law. Please be sure before you file.
